Terms of Service

1. Acceptance of Terms
By creating an account or using Nexelia ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Nexelia is an AI-powered study platform for IB and Cambridge A-Level students. The Service includes structured course content (MCQs, flashcards, exam questions, interactive slides), an AI tutor, a personalised study coach, progress tracking, and community resources.
3. User Accounts
- You must provide accurate information when creating your account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 13 years old to create an account.
- One account per person. Account sharing is not permitted.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to reverse-engineer, scrape, or extract content from the platform.
- Share, redistribute, or commercially exploit Nexelia content.
- Use automated tools (bots, scrapers) to access the Service.
- Abuse the AI tutor or study coach by submitting harmful, offensive, or spam content.
- Circumvent usage limits, access controls, or payment requirements.
5. Subscriptions and Payments
- Nexelia offers free and paid tiers. Paid subscriptions are billed in EUR on a monthly or annual basis.
- Per-subject purchases grant permanent access to that subject's content.
- All payments are processed securely by Stripe.
- Prices are displayed inclusive of applicable taxes.
- Subscriptions automatically renew unless cancelled before the renewal date.
6. Cancellation, refunds and your right to change your mind
Cancelling
- You can cancel a subscription at any time from your account settings or the Stripe billing portal.
- Cancellation takes effect at the end of the period already paid for — access continues until then, and there is no further charge.
Changing your mind — the 14-day right
If you are a consumer in the EU or the UK, you have 14 days from purchase to withdraw, without giving a reason and without penalty. Write to main@nexeliaacademy.com and we will refund you.
⚠ If you ask to start using the service straight away, and confirm that at the time of purchase, you are asking us to begin before those 14 days are up. You keep the right to change your mind during that period, but:
- once the service has been fully performed, the right ends; and
- if you withdraw partway through, you pay the proportionate part of what has already been provided, and we refund the rest.
If you would rather keep the full 14 days untouched, simply do not ask us to start early.
7. Intellectual Property
All content on Nexelia — including questions, flashcards, slides, mark schemes, explanations, and AI-generated study plans — is owned by Nexelia Ltd or licensed to us. You may use this content for personal study purposes only. You may not copy, share, sell, or redistribute any content.
8. AI-Generated Content
The AI tutor and study coach use Google Gemini to generate responses. While we strive for accuracy, AI-generated content may occasionally contain errors. Nexelia does not guarantee the accuracy of AI responses and they should not be treated as a substitute for official textbooks, mark schemes, or teacher guidance. Always verify critical information with your course materials.
9. Community Resources
Users may upload study resources to the community section. You retain ownership of content you upload but grant Nexelia a licence to host and distribute it within the platform. Nexelia reserves the right to remove any content that violates these terms or is reported as inappropriate.
10. Limitation of Liability
Nexelia is provided "as is" without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to exam results, lost study data, or service interruptions. Our total liability is limited to the amount you have paid to us in the 12 months preceding the claim.
11. Termination
We reserve the right to suspend or terminate your account if you violate these terms. You may delete your account at any time from account settings, which will permanently remove all your data.
12. Governing Law
These terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Malaga, Spain. For users in the European Union, nothing in these terms affects your rights under applicable consumer protection laws.
13. Changes to these terms
Not every change to these terms deserves the same treatment. A typo fix and a new ground for suspending your account are not the same thing, and we would rather say in advance how we tell them apart.
Minor changes — clarifying wording, correcting a mistake, updating a link or a name. These take effect when we publish them, and the updated date at the top of this page changes.
Significant changes — anything that alters what the service does, what we do with your data, or what you can expect from us. We will tell you before these take effect, and you will have [TO BE SUPPLIED: notice period] to read them. If you do not want to continue under the new terms, you can stop using the service and delete your account before they apply.
Changes that restrict you — a new prohibition, a new reason we could suspend or close your account, or a tightening of an existing one. ⚠ These do not take effect for you by default. We will ask you to accept them, and until you do you keep using the service under the terms you already agreed to. If you would rather not accept, you can delete your account instead.
We will not treat carrying on using the service as acceptance of a change in that third category. Silence is not agreement to a new restriction.
⚠ Being straight with you about where we are: the re-acceptance step in the third category is a commitment we intend to keep and have not finished building. We can email you individually today, but we do not yet have a way to require you to accept a change before continuing. Until that exists, treat the first two categories as how we will behave, and the third as what we are working towards. We would rather tell you that than describe machinery that is not there.
